Certificate of Authenticity

Fabiola De Ford Art & Design specializes in the creation of original artwork, textile designs, and luxury accessories inspired by the biodiversity, history, and cultural heritage of Costa Rica.

To preserve the authenticity, provenance, and artistic value of these creations, selected pieces may be accompanied by a Certificate of Authenticity issued and signed by the artist.

1. Purpose of the Certificate

The Certificate of Authenticity confirms that the acquired piece is an original creation of Fabiola De Ford Art & Design and has been designed or produced under the artistic direction of its creator.

The certificate may accompany, but is not limited to:

Original works of art;
Limited-edition fine art prints;
Limited-edition silk scarves;
Collectible textile designs;
Selected custom and corporate commissions;
Special collections.

The issuance of a Certificate of Authenticity is at the sole discretion of the artist.

2. Contents of the Certificate

The Certificate of Authenticity may include:

Title of the artwork or collection;
Description of the piece;
Technique or materials used;
Edition number, when applicable;
Year of creation;
Artist's signature;
Official seal or mark of Fabiola De Ford Art & Design;
Internal registration or authentication number, when applicable.

3. Intellectual Property Rights

The Certificate of Authenticity verifies the originality and provenance of the physical piece.

The acquisition of a work or product accompanied by a Certificate of Authenticity does not transfer any copyright, intellectual property rights, reproduction rights, licensing rights, commercial rights, or any other rights of economic exploitation associated with the artwork.

All such rights remain the exclusive property of Fabiola De Ford unless expressly transferred through a separate written agreement.

4. Artist's Reserved Rights

The artist retains all moral and economic rights associated with her creations, including the right to:

Reproduce the artwork;
Publish it;
Exhibit it;
Photograph it;
Commercialize it;
License it;
Adapt it;
Create derivative works;
Incorporate it into future collections or publications.

5. Restrictions on Use

Without the prior written consent of Fabiola De Ford Art & Design, the owner of a certified piece may not:

Reproduce the artwork;
Digitize it for commercial purposes;
Manufacture derivative products;
Use the design in commercial advertising;
License the image of the artwork;

Create merchandise based on the design;
Alter the artwork for commercial exploitation.

Ownership of the physical object does not constitute a transfer of intellectual property rights.

6. Limited Editions

When a piece belongs to a limited edition, the Certificate of Authenticity may indicate its corresponding edition number within the series.

The artist reserves the exclusive right to determine the size and characteristics of each edition and collection.

7. Transfer of Ownership

A Certificate of Authenticity may accompany the transfer of ownership of the physical artwork between collectors.

However, such transfer does not assign or transfer any copyright or commercial exploitation rights associated with the artwork.

8. Loss or Damage of the Certificate

Requests for replacement certificates will be reviewed on a case-by-case basis and may require satisfactory proof of the authenticity and provenance of the artwork.

9. Artistic Value and Provenance

The Certificate of Authenticity serves as documentation of the originality and provenance of the artwork within the official catalogue of Fabiola De Ford Art & Design.

Its issuance contributes to preserving the historical, artistic, and collectible value of the piece.

10. Governing Law

This Certificate of Authenticity Policy shall be governed by the laws of the Republic of Costa Rica and by applicable national and international copyright and intellectual property laws.
